TOUR TERMS AND CONDITIONS

 

GENERAL

The following terms and conditions (the “Terms”), together with any information contained in any event invitation/s, booking forms, booking confirmation, and email communications, apply to all distillery tours run or organized by or on behalf of William Grant & Sons Distillers Ltd, a company registered in Scotland under registration number SC134248 and our registered office is at The Glenfiddich Distillery, Dufftown, Banffshire, AB55 4DH (“we” or “the Company”).

On booking a distillery tour (“Tour”), you agree on your own behalf and on behalf of all guests which form your party to be bound by these Terms. 

In these Terms, “you” means all persons named on the reservation. By making a reservation, the individual named in the booking will be deemed to have accepted these Terms on behalf of all persons within the booking.t 

Please read these terms carefully before using the Website. Using the Website indicates that you accept these terms. If you do not accept these terms, do not use the Website.

How we may contact you. If we need to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us in your booking form.

Use of the website and booking platform is subject to the Website Terms and Conditions ; however, in the case of conflict, these Terms shall apply to online bookings of Tours. https://www.glenfiddich.com/general/terms-and-conditions/

 

OUR CONTRACT

How to book a Tour. You can book a Tour of the Glenfiddich Distillery by navigating to the “Visit the Distillery” section of our website https://www.glenfiddich.com/book-tour and selecting which Tour you require from a range of tours available. On clicking the “Book now” button, you will be asked to select the date, time and number of places required. Following this, select “continue booking” to proceed. You will be asked to enter your name, email ID, contact number and billing address. Please read and check the order summary carefully and if happy, please select “proceed to payment”. If any amendments are required, you can select “change booking” before proceeding to payment.

Payment. You will be able to pay for booked tours using Visa, Mastercard or Maestro. Once you have submitted your payment details, the order will be placed. You may be asked to answer additional security questions by your card issuer. All payments are powered and facilitated by Stripe.

We reserve the right to amend the price of the Tour at any time.

Booking confirmation. Once the order has been completed, you will receive an email to confirm this. At this point a legally binding contract will be in place between us and you.

We accept no responsibility for the incorrect inputting of an email address on our booking form. If your automatically generated booking confirmation does not arrive via email, please contact us via email at Glenfiddich.bookings@wgrant.com, we will check the email address and resend your booking confirmation(s).

Upon receipt of the booking confirmation email, it is your responsibility to check the accuracy of dates booked.

TOURS

All Tour/s are sold subject to availability. Tours must be booked in advance; we do not accept walk-ins. If you are unable to book a Tour on our website due to technical issues, you can call us at +44  01340 820373 to make a phone booking. By making a phone booking, you confirm to have read and agreed to these Terms and our Privacy Notice.

Some housekeeping rules.

• All guests must be aged 18 years or over. If we believe or suspect a guest to be under the legal purchase age, that guest will be asked to produce photo ID. In the event that you are unable to produce valid photo ID, we reserve the right to refuse you entry, or ask you to leave the Tour and we regret that no refunds can be given;

• Please bring evidence of your booking with you. If you have proof of booking on your mobile device, that will be enough;

• For your and our safety whilst on site, please comply at all times with all our health and safety instructions and any other instructions given to you by our personnel;

• Enjoy our products sensibly, drink responsibly and do not drink and drive;

• Photography and filming are generally not permitted on the tour. However, there are some areas where this is allowed and our guides will let you know when it’s ok for you to take pictures during the tour;

• Use of mobile phone and other electronic devices is generally not permitted on the tour. However, there are some areas where this is allowed, and our guides will let you know when it’s ok for you to use such devices;

• You will be responsible for orderly conduct and shall ensure that nothing shall be done which may constitute a breach of the law or in any way cause a nuisance;

• Smoking or vaping can only be done in outside designated areas;

• Distilleries can be dusty and hot, and it rains quite a lot in Scotland. Wear sturdy shoes and casual wear that you don’t mind getting a little dirty;

• We do not allow guests to bring food for safety reasons. 

• No pets or animals are permitted in the distillery (with the exception of assistance dogs, please ensure that you notify our team if you have an assistance dog as there are parts of the experience where an alternative arrangement may need to be made)

• Do not bring any dangerous or hazardous items to the distillery and remove such items promptly when requested to do so by us or a member of our staff.

 

Any special requests should be notified to us at the time of booking. We will try to accommodate your request as much as possible however we do not guarantee that we will be able to.

Please arrive and be ready to start your tour on the date and at the time given (we recommend arriving 15 minutes before the start time). We try to accommodate late arrivals. However, once the tour has departed, it may not be possible to join. 

We reserve the right to refuse admission to the Tour at our absolute discretion.

Security. In the interests of safety, guests may be asked to submit to a search of their person or belongings and anyone refusing to submit or found to be in possession of materials believed by us to be dangerous or unsuitable will be denied entry or removed from the Tour.

We would ask all guests to remain vigilant and report anything they find suspicious to a member of staff.

Alcoholic beverages. We may provide and supply alcoholic beverages for on-site consumption by guests. Any alcoholic beverages supplied shall be of satisfactory quality and reasonably fit for consumption. Any other warranties and liabilities by us, whether implied by statute, common law or otherwise are hereby excluded to the maximum extent permitted by law.

You are strongly encouraged to consume alcoholic beverages in a responsible and safe manner, and we shall not be liable for any losses or damages suffered by you as a result of over-consumption of alcoholic beverages or any resulting nuisance and/or undesirable behavior. 

 

PRICE/FEE

The price of the tour will be stipulated on the website. The price is inclusive of VAT.

The total purchase price, including VAT will be displayed in the order summary prior to you confirming the order, as described above. Tickets must be paid for on our website at the time you make a booking.

Following the receipt of the booking, we will confirm by email the details of your booking and the price.

 

YOUR RIGHTS TO CHANGE OR CANCEL YOUR BOOKING

Change/Cancel booking. Please contact us as soon as possible if you need to make any changes to your booking. If you want to cancel, you must contact us at least 24 hours prior to your tour to receive a full refund. The Glenfiddich tours are usually fully booked in advance, we cannot guarantee your preferred date/time. Please contact us with your new request and we will do our best to accommodate you.

If you cancel a booking with less than 24 hours to your tour commencing, your payment will not be refunded.

If you or any of your guests simply do not arrive for the Tour, no refund will be given for the Tour unless you have given us at least 24 hours’ notice of your cancellation.

We will make the refund without undue delay, and not later than 14 days after the day on which we are informed about the decision to cancel the reservation.

We will make the refund using the same means of payment used for the initial transaction unless expressly agreed otherwise.

In all instances, notification of changes or cancellation must be made in writing to us and will be effective    on the date this is received by our reservations department. Any cancellations or alterations to your bookings should be addressed to Glenfiddich.bookings@wgrant.com

 

OUR RIGHT TO CANCEL THE BOOKING

In the unlikely event that we are required to significantly cancel or alter a material part of your Tour, we will notify you of this as quickly as possible to let you decide how you wish to proceed. If we do this, you will be able (i) to take an alternative tour of equivalent quality if we are able to offer that, (ii) to take a substitute tour of lower quality if we are able to offer that (in which event the difference in price between the original and the substitute tour will be refunded to you); (iii) to reschedule your tour to a date that is suitable to you; or (iv) to cancel your booking and obtain a full refund of all monies paid by you.

 

Cancellation of the tour by us. We may also cancel your booking under the following circumstances:

• You break any of these Terms;

• If the visitor center or any part of it is closed due to circumstances outside of our control; or

• If we think that you and/or your event might have a negative impact on our reputation (or the reputation of our brands) of you and/or your event may cause damage to the distillery.

In such an event, we will refund all payments made by you to us but will have no further liability to you.

 

LIABILITY

We will be liable to you for injury to persons or loss or damage to property only where we have been negligent but otherwise will be under no liability to you whatsoever.

If you suffer losses as a result of a breach by us of these Terms, our liability is strictly limited to the purchase price of the booking for the Tour. We are not responsible for any loss of profit, loss of business, loss of goodwill, or any indirect, special or consequential loss, damage, costs, expenses or other claims which arise in connection with the Tour.

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms and conditions that is caused by events outside our reasonable control (“Force Majeure Event”). Our performance under these Terms is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under these terms and conditions may be performed despite the Force Majeure Event.

We do not accept any responsibility for your personal belongings at the Tour and you are responsible for making sure you keep your belongings with you or in a safe place at the Tour location.

OTHER LEGAL PROVISIONS

We reserve the right to refuse to process a transaction for any reason.

If any provision of these Terms is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and the remainder of the provision in question will not be affected.

These Terms and any document expressly referred to in them constitute the whole agreement between you and us and supersede any previous arrangement, understanding or agreement between you and us relating to the subject matter of these Terms.

Any contract between you and us pursuant to these Terms will be binding on you and us and on our respective successors and assigns.

You may not transfer, assign, charge, sub-contract or otherwise dispose of any such contract, or any of your rights or obligations arising under such a contract, without our prior written consent.

These terms and conditions are governed by and construed in accordance with the Laws of Scotland, and the parties agree to submit to the exclusive jurisdiction of the courts of Scotland.
