“GLENDFIDDICH WORLD’S MOST EXPERIMENTAL BARTENDER – AUSTRALIA/NEW ZEALAND” COMPETITION TERMS AND CONDITIONS

Eligibility Criteria

 

  • Entry is only open to residents of Australia and New Zealand aged 18 years or over who: (a) are employed as a bartender in Australia or New Zealand at the time of entry; and (b) are available to travel to Scotland to compete in the Global Final of the Glenfiddich World’s Most Experiential Bartender Competition for three (3) nights sometime between 07/11/2016 and 11/11/2016, if selected as part of the Winning Team (defined below).

 

  • Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

 

Entry Instructions

 

  • To be eligible to enter, eligible individuals must develop an original and creative on-premise product or form of on-premise service that is inspired by Glenfiddich product(s) and requires collaboration with a third party professional/tradesperson (“third party collaborator”) to be finalised/actualised (“Innovation”). For example, an individual could develop a type of bar glassware product that requires a glassblower to be created, or an individual could develop a type of poetic drink service presentation that requires a poet to be finalised. If the Innovation involves a cocktail recipe, it must contain a minimum of 25ml of a Glenfiddich whisky and the total combined alcoholic ingredients must be equivalent to no more than 75ml at 40% alc./vol (i.e. no more than 3 units of alcohol per serve).

 

  • To enter, eligible individuals must then complete the following steps:

  • attend one of the Glenfiddich World’s Most Experiential Bartender Competition Australia/New Zealand presentation events (each a “Presentation Event”) outlined in the table below and obtain a registration form from a member of staff at the Presentation Event;

  • fully complete the registration form with all of the requested personal details (including their full name, telephone number, a valid email address), provide an explanation in 200 words or less how their Innovation was inspired by the Glenfiddich brand, agree to the Terms and Conditions and the Promoter’s Privacy Policy by ticking the relevant tick box, and then return the fully completed registration form to a member of staff at the Presentation Event (“Registration”). Once a Registration has been completed, individuals will be placed in a queue for the chance to present their Innovation to a panel of judges; and then

  • once their name is called, present their Innovation to the panel of judges (“Presentation”). The Presentation should address what their Innovation is and all of the relevant details/specifications, what type of third party collaborator they will need in order to create/finalise/actualise their Innovation, how the Glenfiddich brand inspired their Innovation, and how they would promote their Innovation in on-premise venues and social media. Individuals will also be required to answer any questions the panel of judges ask them regarding their Innovation. Individuals can also bring photos, props or other items to help further demonstrate their Innovation.

 

Presentation Events will be conducted at the following locations, dates and time:

  • The Dominion League in Perth WA on 21/06/2016 from 1pm to 6pm;

  • Captain Melville, Melbourne VIC on 29/06/2016 from 1pm to 6pm;

  • Electra House in Adelaide SA on 06/07/2016 from 1pm to 6pm;

  • Rambling Rascals, Sydney NSW on 11/07/2016 from 1pm to 6pm;

  • Cobbler, Brisbane QLD on 27/07/2016 from 1pm to 6pm;and

  • Venue TBC in Auckland NZ on 13/07/2016 from 1pm to 6pm;

 

  • Only one (1) entry permitted per person.

 

  • Incomplete, indecipherable, or illegible Registrations entries will be deemed invalid. Entries submitted by a third party or agent will not be valid.

 

Finalist Determination

 

  • The Innovations presented at each Presentation Event will be individually judged against all other Innovations presented at that Presentation Event based on the judging criteria outlined below:

  • Glenfiddich Inspiration – how the Innovation was inspired by, or with, any Glenfiddich expressions and whether the Innovation is something that consumers of Glenfiddich will love and talk about;

  • Experimentation/Originality – how the Innovation demonstrates true maverick spirit, innovation and experimentation;

  • Activation Success – how feasible it will be to utilise the Innovation in on-premise venues in Australia or New Zealand; and

 

  • The best Innovation presented at each Presentation Event, as determined by the judges in their absolute discretion, will each be deemed a finalist in this promotion (“Finalist”). For the sake of clarity, there will be one (1) Finalist at each Presentation Event, for a total of six (6) Finalists.

 

  • The Finalists will be notified by email. Finalists must reply to the Promoter’s email within 14 days of receipt. If a Finalist fails to contact the Promoter within this timeframe, they will be deemed invalid and disqualified, and the next best entrant from the relevant Presentation Event will be deemed the Finalist (subject to this clause).

 

  • Each Finalist will be awarded $1,000 in their local currency (“Finalist Prize”) to actualise their Innovation with a third party collaborator. The third party collaborator must be an Australian or NZ resident aged 18 years or over, and must agree to these Terms and Conditions to be eligible to participate work together with the Finalist (“Collaborator”). If the Finalist does not already have a specific Collaborator they are able to work with on their Innovation, the Promoter will assist the Finalist in finding a suitable Collaborator. The Finalist and their Collaborator together will form a “Finalist Team”.

 

  • Each Finalist Team must then work together to create either a mock-up of their Innovation (if their Innovation is a physical item) or a video of them demonstrating their Innovation (if their Innovation is not a physical item) (each an “Innovation Prototype”). For example, if the Innovation is a bar glasswear product, the Finalist Team will create a mock-up of that bar glasswear product; if the Innovation is a poetic drink service presentation, the Finalist Team will create a video of them demonstrating that presentation.

 

  • Once the Innovation Prototype has been finalised by a Finalist Team, it be must be sent to Mark Little, William Grant and Sons, Suite 21.02, Level 21, 111 Pacific Highway, North Sydney, NSW, 2060 so it is received by 5pm on August 10th 2016.

 

Winner Determination & Prize

 

  • The Promoter will the review all Innovation Prototypes received against each other based on the judging criteria outlined in clause 7 above. The judging will take place at William Grant and Sons,m Suite 21.02, Level 21, 111 Pacific Highway, North Sydney, NSW 2060 from August 15th 2016.

 

  • The best valid Innovation Prototype, as determined by the judges, will be deemed the winner (‘Winning Team”).

 

  • The Winning Team will be awarded a trip to Glasgow, Scotland to compete in the Global Finals of the Glenfiddich World’s Most Experiential Bartender Competition, valued at up to AU$8,000 depending on date and point of departure (“Major Prize”). The Major Prize includes the following components for both members of the Winning Team (i.e. the original entrant and the Collaborator):

  • return economy airfares from the Winning Team’s nearest Australian capital city (if they reside in Australia) or from the nearest of Auckland (if they resides in New Zealand) to Glasgow, Scotland;

  • return transfers from the Glasgow airport to the accommodation in Dufftown;

  • three (3) nights twin share accommodation in Dufftown (exact hotel determined by the Promoter in its absolute discretion);

  • daily hotel breakfast on a set-menu;

  • return transfers from the accommodation to the Glenfiddich Distillery in Dufftown;

  • a tour of the Glenfiddich Distillery in Dufftown; and

  • the opportunity to participate in the Global Finals of the Glenfiddich’s World’s Most Experimental Bartender Competition at the Glenfiddich Distillery in Dufftown. The exact date the Finalist Team will compete will be determined by the Promoter, but will be sometime between 07/11/2016 and 11/11/2016.

 

  • The following conditions apply to the Major Prize: Spending money, additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken sometime between 07/11/2016 and 11/11/2016 to coincide with the Glenfiddich’s World’s Most Experimental Bartender Competition event, on exact dates determined by the Promoter, and is subject to booking and flight availability. Itinerary to be determined by the Promoter in its absolute discretion. The Winning Team are responsible for ensuring that they have valid passports (valid for at least 6 months on date of travel), and any requisite visas, vaccinations, travel documentation and travel insurance. The Promoter may require evidence of these documents. The Winning Team must depart from and return to the same departure point and travel together. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The Winning Team may be required to present their credit card at time of accommodation check in. The Promoter reserves the right to change the dates or venue of any part of the Major Prize or of the Global Final of the Glenfiddich’s World’s Most Experimental Bartender Competition, if required, and the Promoter will make all reasonable efforts to keep Winning team informed if this happens. All elements of the Major Prize package must be taken as part of the same trip. The Winning Team must inform the Promoter of any wheelchair or any similar access needs. The Winning Team must not do anything which could, in the reasonable opinion of the Promoter, bring the Promoter or any of its Associates into disrepute before, during or after this promotion.

 

  • The Winning Team will be notified by email, and their names will be published online at www.glenfiddich.com on December 1st 2016.

 

General

 

  • Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. These terms and conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entrants and Collaborators should retain a copy for their information.

 

  • The promoter is William Grant & Sons Australia Pty Ltd (ABN 59 142 683 145) of Level 21, 111 Pacific Highway, North Sydney NSW 2060, telephone (02) 9409 5114 (“Promoter”).

 

  • The Promoter reserves the right, at any time, to verify the validity of entries, entrants and Collaborators (including an entrant’s or Collaborator’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. Proof of residence and age will be requested. Any information requested must be provided within 14 days of the request.

 

  • If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

 

  • This is a game of skill and chance plays no part in determining the Finalists or Winning Team.

 

  • The Promoter’s decision is final and no correspondence will be entered into.

 

  • If for any reason a Finalist or Winning Team does not take/redeem a prize (or an element of a prize at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

  • If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

 

  • Total prize pool value is up to $14,000.

 

  • The prizes, or any unused portion of the prizes, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

 

  • Entrants agree that they are fully responsible for any materials they submit via the promotion including but not limited to Innovations (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that:

 

  • they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;

  • their Content shall not contain viruses or cause injury or harm to any person or entity;

  • they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;

  • the Content is the original work of the entrant that does not infringe the rights of any third party;

  • they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights;

  • they will not suggest or encourage irresponsible drinking or behaviour or that feature anyone who is under the age of 25;

  • they will not contain or refer to any third party brand or competitor of the Promoter and must not contain or reference any third party names, logos and/or trademarks and

  • they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

 

Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.

 

  • As a condition of participating in the promotion, each Finalist Team agrees to assign all of their rights, title and interest (including copyright) in and to their Innovation and Innovation Prototype to the Promoter, and to execute any documents to confirm such assignment. Entries will not be returned to any Finalist Team or Winning Team.

 

  • As a condition of accepting the Major Prize, each member of the Winning Team will be required to participate in promotional/marketing publicity events in commination with this promotion, and consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. In the event a member of the Winning is under the age of 25, that individual will not be eligible to participate in any marketing/publicity events due to the Promoter’s obligations regarding the responsible marketing of alcoholic products in Australia and New Zealand.

 

  • If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant or Collaborator; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

 

  • Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

 

  • Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the Global Final of the Glenfiddich World’s Most Experiential Bartender Competition event is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) taking/use of a Finalist Prize and/or participation in the Major Prize.

 

  • As a condition of accepting the Major Prize, each member of the Winning Team must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

 

The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au/publications/synopses/ds10syn.htm.

 

  • The Promoter collects personal information ("quot;PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.williamgrant.com/privacy_statement.html. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the individual. The Privacy Policy also contains information about how individuals may opt out, access, update or correct their PI, how individuals may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose Australian individuals’ personal information to any entity outside of Australia.

 

  • The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia. Void where prohibited.
